Terms and Conditions
The core idea behind the Hague Workshop is that all users are jointly responsible for the atmosphere, safety and progress. To manage this effectively, some rules have been drawn up for users:
Permission must be sought before using an individual machine. Each user should be familiar with the machine(s) and/or tools they intend to use, as well as the associated safety measures. Its function and presence must be checked before each use. If someone is not sufficiently familiar with its operation or use, they must first follow an instruction or course.
General Terms and Conditions for the Use of the Hague Workshop.
Applicability: These general terms and conditions apply to the use of the public workshop (“the Hague Workshop”). By using the workshop, the user agrees to these conditions.
Purpose of use: The workshop is intended for carrying out various activities, such as carpentry, metalworking, welding, and other craft or technical activities. It is not permitted to use the workshop for illegal, dangerous or unauthorized activities.
Access and Reservations: The workshop may be available for use based on reservations, membership or an access card system. The user must adhere to the requirements and procedures established by the workshop manager in order to access and use the facilities.
Safety: The user is responsible for complying with all safety regulations and the correct use of the tools, machines and materials in the workshop. It is mandatory to wear personal protective equipment such as safety glasses, hearing protection, gloves and suitable clothing. It is also prohibited to enter the workplace under the influence of alcohol or drugs.
Liability: The user of the workshop is liable for any damage to the workshop, tools, machines or other property of the workshop. De Haagse Werkplaats cannot be held liable for personal injury or damage to property of the user while using the workshop.
Hygiene and Cleanliness: The user is responsible for cleaning and tidying up the workplace after use. Used tools and materials must be put back in their correct place. It is not permitted to leave waste or hazardous substances in the workshop. It is important to maintain a clean and safe environment for all users.
Termination of Use: De Haagse Werkplaats reserves the right to refuse, suspend or terminate access to the workshop in the event of violation of these general terms and conditions, inappropriate behavior, violation of safety regulations or other reasons that are justified in the workshop's sole discretion.
Insurance: The user declares that he has valid third party liability insurance.
By using the public workshop, the user declares that he has read, understood and agreed to these general terms and conditions.
Conditions for Participation in Courses
Article 1. Definitions
1. The Hague Workshop, Workshop for people, wood and crafts, hereinafter referred to as 'the Hague Workshop'.
2. Participant: the natural person with whom an agreement regarding participation in a course has been concluded and who actually participates in the course.
3. Course: course or year with the aim of transferring and/or increasing knowledge and/or skills in the field of fine woodworking.
4. Conditions: these general terms and conditions.
Article 2. Applicability
1. The conditions apply to all agreements concluded between 'de Haagse Werkplaats' and the participant, any amendment or addition thereto, as well as all (legal) acts in preparation and implementation of that agreement.
2. A registration in the manner stated in Article 3, paragraph 1, implies acceptance of the applicability of these conditions. Article 3. Registration and confirmation of course
3. Participants can register for the courses provided by 'de Haagse Werkplaats' by purchasing a course on the website of 'de Haagse Werkplaats'.
2. 'De Haagse Werkplaats' confirms a registration that has been made in the manner stated in the previous paragraph by e-mail/electronic mail. By sending this confirmation, the agreement regarding participation in the relevant course is concluded.
Article 4. Prices of a course
1. When registering by purchasing the course on the website of 'de Haagse Werkplaats', the prices as stated on the website at the time of registration apply unless there is a clear error.
2. The course prices include the costs for the course materials, unless stated otherwise.
3. All prices include VAT and are charged as such.
Article 5. Payment
1. Payment for the course must be made immediately when registering for the course on the website of 'de Haagse Werkplaats'
Article 6. Cancellation of course by the participant
1. Cancellation by the participant of the agreement regarding a course is only possible by registered letter up to four (4) weeks before the planned first day of the course.
2. If you cancel up to four (4) weeks before the first day of the course, €100 (incl. VAT) will be charged. In case of cancellation from four (4) weeks to one (1) week before the first day of the course, 50% of the course amount due will be charged as cancellation costs. In case of cancellation within one (1) week before the first day of the course, the full course fee is due and the participant is not entitled to a refund of anything already paid.
3. Cancellation by the participant of the course agreement after the start of the course is not possible. Substitution by a third party is not permitted unless the Hague Workshop has given written permission for this. Whether or not to grant this permission is solely at the discretion of The Hague Workshop. If written permission has been given for the substitution by The Hague Workshop, an additional administration fee of € 150 (incl. VAT) will be charged to the original participant.
Article 7. Cancellation of course by 'de Haagse Werkplaats'
1. 'De Haagse Werkplaats' reserves the right to cancel the course up to three (3) days before the first day of the course. The participants will be informed of this immediately. 'De Haagse Werkplaats' will refund the course fee paid by the participant. If possible, 'De Haagse Werkplaats' will offer the participant an alternative. If the participant makes use of this, the course fee will not be refunded.
Article 8. Liability
1. Participation in the courses of 'de Haagse Werkplaats' is at the risk of the participant. Except in the case of intent or gross negligence on the part of 'de Haagse Werkplaats' itself, 'de Haagse Werkplaats' is not liable for any form of damage, including consequential damage or personal injury that the participant suffers as a result of accidents that happen during the course, unless and insofar as exclusion of liability may not be legally permitted. *2. 'De Haagse Werkplaats' is not liable for any damage caused by or related to participation in a course of 'de Haagse Werkplaats' or the cancellation of the course agreement by 'de Haagse Werkplaats', unless there is intent on 'de Haagse Werkplaats' or gross negligence can be blamed.
2. 'De Haagse Werkplaats' does not guarantee the soundness of the work created by a participant. Any liability for damage caused by the use of a workpiece manufactured at The Hague Workshop is excluded.
3. If a participant places his/her work in storage at 'de Haagse Werkplaats' during or after a course period, 'de Haagse Werkplaats' is not liable for any damage caused or arising to this work from any cause whatsoever. The storage of a workpiece is therefore entirely at the participant's own risk. The participant is aware that such damage is not covered by any insurance that 'de Haagse Werkplaats' has taken out.
4. If, despite the provisions of the previous paragraphs, 'de Haagse Werkplaats' is liable for any damage at any time, this will be limited to a maximum of the invoice amount.
5. Indirect damage will not be reimbursed.
6. The participant is recommended to take out accident insurance.
Article 9. Prevention by 'the Hague Workshop'
1. If 'de Haagse Werkplaats' cannot fulfill its obligations towards the participant due to serious circumstances, 'de Haagse Werkplaats' is entitled to change, move or cancel the course. If possible, 'de Haagse Werkplaats' will offer the participant an alternative.
2. If the participant rejects the alternative for valid reasons, he must immediately inform 'de Haagse Werkplaats'. In such a case, 'De Haagse Werkplaats' undertakes to refund a proportionate portion of the course fees.
3. 'De Haagse Werkplaats' is never obliged to compensate any damage resulting from the course not going ahead.
Article 10. Intellectual property
1. The course material provided becomes the property of the participant. The intellectual property rights relating to the course, the course material and any other documents/products relating to the course are reserved by 'de Haagse Werkplaats'.
2. Without the express written permission of 'de Haagse Werkplaats', the participant is not entitled to disclose, exploit or in any way reproduce data from and/or parts and/or extracts of the course material provided.
Article 11. Replacement course supervisor
1. 'De Haagse Werkplaats' is at all times entitled to replace a course supervisor charged with the execution of the course agreement with another course supervisor.
Article 12. Applicable law
1. Dutch law applies to all quotations and agreements between 'de Haagse Werkplaats' and the participant.
2. All disputes that arise between the parties as a result of a quotation or agreement to which these terms and conditions apply or as a result of agreements arising from them, will be submitted to the competent court in Utrecht, unless the law prescribes otherwise.
